Loyalty obligations in contractual relationships
For the first time in the history of German-Norwegian trade relations, a German company was involved in a contractual dispute before the Norwegian Supreme Court (Høyesterett). In particular, the court discussed the circumstances under which a duty of loyalty exists and how far such a duty can extend, taking into account or even contrary to the express wording of the contract.
The ruling thus provides decisive new guidance for both national and international contractual relationships.
Gain an insider's view as Sigrid Graw, lawyer at the German-Norwegian Chamber of Commerce, who attended the proceedings, briefly introduces the general duty of loyalty in contractual relationships. Thereafter, Henning Harborg and Julie Rasmussen Solli of Thommessen, who presented the German company in the Court of Appeal and the Supreme Court, will present the judgment and its legal and practical implications, then open the floor for questions.

About the speakers
Sigrid Graw is a German lawyer licensed in Norway and employed by the German-Norwegian Chamber of Commerce. One focus of her work is tax law and employment contract regulations. In addition, our members naturally also have questions on a wide variety of other legal topics, which she is happy to assist with.
Julie Rasmussen Solli works with dispute resolution and advisory in intellectual property law, marketing law, and general contract law. She has particular expertise in consumer and marketing law, and advises both Norwegian and international companies on legal issues related to marketing and supply of goods and services. She has extensive experience assisting clients in retail and e-commerce, as well as foreign businesses launching goods or services in the Norwegian market.
Henning Harborg is a litigator and arbitrator who specialises in major commercial disputes. He has more than twenty years of contentious experience, having pleaded hundreds of cases both in Norway and internationally. Henning focuses on contract law, company law, securities law, insolvency law and tort law. He has in recent years also defended several major white-collar crime cases.
